Functions:
- Implements the national intellectual property strategy, including formulating major guidelines and development plans
- Protects intellectual property rights. Formulates and strictly implements intellectual property rights systems such as trademarks, patents, geographical indications of origin, and layout design of integrated circuits. Organizes drafting of relevant laws and regulations, drafts departmental regulations, and supervises implementation
- Studies policies to encourage intellectual property protection, management and service in new areas, new formats and new models
- Guides trademark and patent enforcement, including local intellectual property dispute resolution, rights protection assistance and dispute mediation
- Promotes use of intellectual property. Standardizes the evaluation of intellectual property intangible assets and manages compulsory patent licensing. Formulates policies and measures for the development and supervision of IP intermediary services
- Examines and records intellectual property rights and administrative rulings. Implements trademark registration, patent examination, and registration of integrated circuit layout designs. Responsible for administrative rulings on trademarks, patents, layout reviews of integrated circuits and invalidation. Drafts and implements the identification system for geographical indications of origin
- Manages the public service system for intellectual property rights, including: establishing a national IP information public service platform and disseminating intellectual property rights information
- Plans and coordinates foreign-related intellectual property matters, including proposing internationally oriented policies on intellectual property, negotiating external intellectual property rights matters, and managing international exchange programs
- Completes other tasks assigned by the Party Central Committee and the State Council
